Latest clarification regarding stepping up of pay of Senior Assistants of CSS

Subject: Clarification on application of the DOPT’s OM No. 7/7/2008-CS.I (A) dated 22.12.2010 and 18.03.2011 regarding stepping up of pay of Senior Assistants of CSS on/after 1.1.2006 vis-a-vis notional fixation of pay.
Attention is invited to this Departments OM of even number dated 22.12.2010 and 18.03.2011 on the above subject. Subsequently, Ministries/Departments have sought clarifications on the same subject, the details of which have been listed as under:

from 1s` July of the Select List year. The
option would apply to all such officers
covered by the OM No. 6/3/2009-CS.I (S)
dated 09.07.2010, irrespective of the fact
whether they are included in the Select List
from Seniority or the Departmental Exam
stream.

Whether pay of the            SOs of CSS
belonging to LDCE quota for the years
2004     and   2005   who   actually   took
charge      as     Section     Officers     after
2.1.2006, but were working as regular
Assistant      on    02.01.2006    is    to    be
stepped up with that of Shri G.M.
Kabui who was appointed as adhoc
Assistant w.e.f 02.01.2006?
Claims of Section Officers who opt to have
their pay fixed in the grade of Section
Officers        from     the      date     of     actual
appointment for stepping up of pay may be
examined     in    the    light     of    instructions
already               issued               by              this
Department/Department      of     Expenditure
vide OM No.          7/7/2008-CS.I (A) dated
22.12.2010 and 18.03.2011.
2.     This issues in consultation with Establishment (Pay) of this Department.
3.    A11 the Ministries/Departments are requested that necessary action may be taken in line with the clarifications as stated above.

Stepping up of pay of senior PAs of CSSS on their regular promotion with reference to their junior.

OFFICE MEMORANDUM
Subject: Stepping up of pay of senior PAs of CSSS on their regular promotion with reference to their junior.
The undersigned is directed to refer to this Department’s O.M. of even number dated 31.5.2011 vide which stepping up of pay of senior PAs of CSSS appointed/promoted prior to 1.1.2006 and drawing less pay than PAs of CSSS promoted after 1.1.2006 was allowed by this Department.
2. The issue regarding anomalies in pay that have arisen to CSSS officers who have got ACP before 1.1.2006 followed by the regular promotion after 1.1.2006 due to different mode of pay fixation issued by the Department of Expenditure vide their U.O. note No.10 / 1 / 2009-IC dated 14.12.2009 has been examined in consultation with the Department of Expenditure. It has been decided that PAs of CSSS who were allowed ACP before 1.1.2006 but who were promoted as PAs in CSSS after 1.1.2006 may be. allowed stepping up of pay on such regular promotion with reference to their junior who were promoted after 1.1.2006 subject to the condition that the senior was receiving more pay than junior before such ACPs.

OFFICE MEMORANDUM

Subject:- Extension of the term of ad-hoc promotion/appointment of PPS of CSSS as Sr. PPS of CSSS — reg.

   The undersigned is directed to refer to this Deptt’s OM’s of even no.dt.29.03.2011, 2.06.2011, 18.07.2011 & 4.08.2011 and to say that the position regarding continuation of ad hoc promotions in the grade of Sr. PPS has been reviewed and it has been decided to extend further, the term of ad-hoc appointments of officers, as shown in Annexure to this OM, upto 30.11.2011
or till regular Sr. PPSs become available or until further orders whichever is earlier.

   2. The continuation of ad hoc promotion of the 23 officers, shown in the Annexure, beyond 30.09.2011 to the post of Sr.PPS is purely ad hoc in nature and shall not confer any right on them to continue in the posts indefinitely or to claim seniority in the grade of Sr. PPS of CSSS.

Subject:- Filling
up the post of Deputy Director in Pay Band -3 (Rs.15600-39100) and Grade Pay
of Rs.6600/- in the Sub-Regional Office of Staff Selection Commission (MPR),
Raipur, Chhattisgarh on Deputation basis.



It is proposed to fill up one vacancy of Deputy Director in Pay Band-3
(Rs.15600-39100) and Grade Pay of Rs.6600/- in the Sub-Regional Office of
Staff Selection Commission (MPR), Raipur on Deputation basis as per the
details given below:

(I) Eligibility Conditions:

Eligibility conditions prescribed for the deputation are asunder:
Officers of the Central Govt.:-

(a) (i) Holding analogous post on regular basis in the parent cadre or
department; or

(ii) With five years’ regular service in the grade rendered after
appointment thereto on a regular basis in posts in the scale of pay of
Rs.S000- 13500(revised to PB-2 1s.93OO-3480Q + Rs.5400 Grade Pay) or
equivalent in the Parent Cadre/Departments; or

(iii) With ten years regular service in the Grade rendered after appointment
thereto in a regular basis in posts in the Scale of Pay of
Rs.6500-10500(revised to PB-2 Rs.9300-34800/- + 4200 Grade Pay) or
equivalent in the Parent Cadre/Department;and

(b) Possessing the following educational qualifications and experience:

(i) bachelors degree in any discipline or a recognised University or
equivalent;

(ii) at least 3 years experience in administration.

Note: For the purpose of computing minimum qualifying service for
appointment on deputation basis, the service rendered on a regular basis by
an officer prior to 1.1.2006 that is the date from which the revised pay
structure based on 6’ CPC recommendation has been extended, shall be deemed
to be service rendered in the corresponding grade pay/pay scale extended
based on the recommendation of the Commission except where there has been
merger of more than on pre-revised scale of pay to one
grade with a common grade pay/pay scale and where this benefit with extend
only for the post(s) for which that grade pay/pay scale is the normal
replacement grade without any upgradation.

(II) Regulation of Pay and other Terms of deputation:

The pay and other terms of deputation will be regulated under the provisions
contained in the Department of Personnel& Training O.M.
No.2/29/91-Estt.(pay-II) dated 05.01.1994 as amended from time to time.

(III) Age Limit:

The maximum age limit for appointment by transfer on deputation shall not
exceed 56(fifty six) years as on the closing date of receipt of
applications.

(IV) Nature of Duties:

The job inter-alia, involves all activities in connection with the conduct
of examinations particulary fictation of venues, co-ordination with State
Governments/Heads of Schools and Colleges etc. The Deputy Director(MPR) is
the head of the sub-regional office situated at Raipur,Chhattisgarh at
present.

(V) Period of Deputation:

The period of deputation including period of deputation in another excadre
post held immediately preceding this appointment in the same or other
organisation/department of the Central Govt. shall not ordinarily exceed
three years.

2. Application along with Bio-data(in duplicate) in the prescribed
Proforma(Annexure-l) of the eligible candidates whose services can be spared
immediately on selection, together with the certificate from the forwarding
Authority(in proforma Annexure-II) along with the following documents:

(i) Integrity Certificate
(ii) List of major/minor penalties imposed if any, on the official during
the last 10 years;(if no penalty has been imposed a ‘nil’ certificate should
be enclosed).
(iii) Vigilance Clearance certificate.
(iv) Attested photocopies of the ACRs for the last five years i.e.
w.e.f.2006-2007 to 2010-2011(each page attested by an officer not below the
rank of an Under Secretary to the Govt. of india) may be forwarded to Shri
R.K. Arora, Under Secretary(Estt-II), Staff Selection
Commission,(Departmeflt of Personnel& Training), Block No.12, CGO Complex,
Lodi Road, New Delhi- 110003 on or before 24/10/2011. Applications not
forwarded through proper channel or those received without the requisite
certificates and necessary documents will not be entertained.

3. The candidates who apply for the post will not be allowed to withdraw
their candidature subsequently.

Subject:- Non-Functional upgradation for Officers of Organized Group ‘A’ Services in PB-3 and PB-4


   A reference is invited to this Department OM No.AB.14017/64/2008-Estt.(RR) dated 24.04.09 on the above subject. The details of batch of the officers belonging to the Indian Administrative Service who have been posted at the Centre in the various grades of PB-3, PB-4 and HAG was last circulated in this Department OM of even No. dated 04.01.2011.

   2. The details of the IAS officers who have been subsequently posted in the Centre in the various grades as well as the date of posting of the first officer belonging to the batch is annexed. Necessary action may be taken for grant of higher scale for the Officers belonging to batches of Organized Group A Services that are senior by two year or more and have not so far been promoted to that particular grade in accordance with the provisions of this Department’s OM No.AB. 14017/64/2008-Estt. (RR) dated 24.4.2009.

Subject: Combined Section Officers’/Stenographers’ (Gr.’B’/Gr.I) Limited Departmental Competitive Examination, 2006, 2007 and 2008.

1. The undersigned is directed to refer to this Department’s OM of even number dated 29th October, 2010 and subsequent reminders dated 14th January, 2011 , 14th February, 2011 and 26th April, 2011 on the subject mentioned above.

2. All the cadre units were requested to keep in readiness complete ACRS/APARs in respect of officials who applied for the Combined Limited Departmental Examination, 2006, 2007 and 2008 so that the result of the said Examination could be declared in a compressed time schedule and in a time bound manner. It was also requested to furnish the status confirming that the ACRs/APARs are in readiness in respect of candidates who appeared in the LDCE by 2.5.2011 in the proforma.

3. However, the status report so far compiled shows that only a few cadre units have furnished the the information stating that the APARs are in readiness. All the cadre units of CSS and CSSS are once again requested to initiate action for completion of ACRs/APARs in respect of candidates who appeared in the Combined LDCE immediately to enable the UPSC to finalise the results as early as possible.

                                          OFFICE MEMORANDUM

Subject:  Consolidated orders on Seniority- Fixation of Seniority of released  Emergency Commissioned and Short Service Commissioned  Officers of the Armed Forces -Clarification regarding consolidated  instructions on seniority issued vide O.M. dated 03.07.1986.

1.   Attention is invited to para 4.1 1 and 4.12 of this Department’s O.M. of  even number dated illh November 2010 incorporating instructions on fixation of  seniority of released Emergency Commissioned officers and Short-Service  Commissioned officers of the Armed Forces of the Union appointed against vacancies  reserved for them in both the Central Civil Services Group ‘A’ and Group ‘B’ and  Engineering and Medical Services posts. These instructions were originally circulated  vide Notification No. 9120169-Estt.(C) dated 26.08.1971 and Notification No. 9114171-  Estt.(C) dated 25.1 1.1971 and were operative for the period 29.01.1971 to 29.01.1974.  Similarly para 4.10 incorporated instruction on fixation of seniority of Civil  Government servants who are permitted to take up military service during emergency  and of Civil government servants who are members of Defence Reserve/territorial  Army/Auxiliary Air Force and are called up for military service during emergency  which were issued vide MHA O.M. No.35115163-Estt(B) dated 28.04.1965.

2.   Reference is also invited to this Department’s O.M. dated 03.07.1986 vide  which consolidated instructions on seniority were issued but the instructions on  seniority of Emergency Commissioned officers and Short-Service Commissioned  officers were not included. References are being received from various  Ministries Departments regarding determination of Seniority of released Emergency Commissioned officers and Short-Service Commissioned officers who joined after
29.01.1974. It is clarified that the instructions circulated vide Notification No. 9120169-  Estt.(C) dated 26.08.1971 and Notification No. 911417 1-Estt.(C) dated 25.1 1.1971 were  applicable to candidates who were appointed against the vacancies reserved under sub-  rule (1) of Rule 4 of the Released Emergency Commissioned Officers or Short Service  Commissioned Officers (Reservation of vacancies) Rules 1971 during the period  29.01.1971 to 29.01.1974 only. These instructions continue to be operative to regulate   pending cases of seniority, if any, of the officers who were appointed against the  vacancies reserved under the provisions of said rule. This may be brought to the notice  of all concerned for information, guidance and necessary action.
